By accessing or using kokishin-arts.com, you agree to these Terms of Use. Please read them carefully. If you do not agree, please do not use the platform.
Kokishin Art & Events ("we," "us," "our") operates an online auction and events platform connecting artists, collectors, auction bidders, venue partners, and sponsors. These Terms apply to all visitors and registered users of kokishin-arts.com and all associated pages and member portals.
You must be at least 18 years of age to register as a bidder, create an account, or place bids. By registering, you confirm that you meet this requirement. We reserve the right to verify age and identity and to refuse or terminate accounts that do not comply.
To participate in auctions you must register and receive a paddle number. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.
You are responsible for maintaining the security of your account credentials. Do not share your password or one-time verification codes with anyone. Notify us immediately if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
Each individual may hold one bidder account. Creating multiple accounts to circumvent bid limits or auction rules is prohibited and may result in permanent disqualification.
All bids placed on this platform are legally binding offers to purchase. By placing a bid you agree that, if you are the winning bidder, you are obligated to complete the purchase at the hammer price plus applicable buyer's premium and any applicable taxes.
Bids must meet or exceed the minimum bid increment set for each auction. The platform will reject bids below the current high bid or minimum increment.
Some lots carry a confidential reserve price — the minimum price the seller will accept. If bidding does not reach the reserve, the lot may pass unsold. We will indicate when a reserve has been met.
Bids may not be retracted once placed except in cases of a clear typographical error, which must be reported to us immediately. We will evaluate retraction requests at our sole discretion.
The auctioneer's decision on all bidding matters is final. We reserve the right to reject any bid, re-offer any lot, advance the bidding, and withdraw any lot from sale at any time before the hammer falls.
Lots designated with a "Buy Now" price may be purchased immediately at that price, subject to auction status and any applicable approval policy. Buy Now purchases carry the same binding obligation as hammer sales. Once a Buy Now purchase is confirmed, the lot is closed to further bidding.
A buyer's premium is added to the hammer price of each sold lot. The applicable percentage is stated on each auction's detail page. The buyer's premium is part of the total purchase price and is due at settlement.
Winning bidders are expected to complete payment within the time period specified for each auction (typically within 5 business days of the auction close). Acceptable payment methods will be specified at the time of purchase. Failure to pay may result in account suspension, forfeiture of any deposit, and pursuit of legal remedies.
Lot descriptions are provided for informational purposes and represent our best understanding of the work based on information provided by the consigning artist or owner. We do not guarantee the accuracy of title, attribution, provenance, condition, or authenticity of any lot unless explicitly stated in writing. Bidders are encouraged to review available images carefully and contact us with questions before bidding.
All lots are sold as-is unless otherwise stated. Returns are not accepted except where explicitly authorized in writing by us.
Artists and venue partners who participate in Kokishin Art & Events events agree to represent their work accurately, retain all necessary rights to consign or display the work, and fulfill their obligations to winning bidders upon sale. Separate partnership agreements may govern specific terms of participation. These Terms do not supersede any signed partnership agreement.
Submission of an artist, venue, or sponsor application does not guarantee acceptance. We review all applications and respond at our discretion. Submitting false or misleading information in an application may result in permanent disqualification.

All content on this platform — including the Kokishin Art & Events name, logo, design, written content, and photography — is owned by or licensed to us. Artist works displayed on the platform remain the property of the respective artists or rights holders. You may not reproduce, distribute, or use any platform content without our written permission.
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or harmful components. We disclaim all warranties regarding the accuracy, completeness, or fitness for purpose of any content or lot description.
To the maximum extent permitted by applicable law, Kokishin Art & Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, loss of data, or disruption of auction access. Our total liability for any claim arising from your use of the platform shall not exceed the buyer's premium you paid in the relevant transaction.
You agree to indemnify and hold harmless Kokishin Art & Events, its officers, agents, and partners from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the platform.
We may update these Terms of Use at any time. Changes take effect when posted to this page with an updated effective date. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the platform shall be resolved through good-faith negotiation or, if necessary, through binding arbitration or the courts of competent jurisdiction.
